The Company
'Golf -The American Way' is a trading name of Up & Away Limited which is a fully bonded ATOL licence holder.
Contract
The booking conditions on this website shall form the basis of the contract between Up & Away trading as 'Golf -The American Way' and with the person booking the holiday. No contract shall exist until 'Golf -The American Way' has received a deposit as defined below in the 'Payment' section and the customer has received written Confirmation Invoice from 'Golf -The American Way'.
Atol Protection
The air holidays and flights in this website are ATOL protected, since we hold an Air Travel Organiser's Licence granted by the Civil Aviation Authority. Our ATOL number is ATOL 3555. In the unlikely event of our insolvency, the CAA will ensure that you are not stranded abroad and will arrange to refund any money you have paid to us for an advance booking. Payment
A deposit of £125 per person, with the insurance premium is required to confirm a reservation. The balance must be received at least 8 weeks before departure. Reservations made less than 8 weeks before departure must be paid in full at the time of booking. In default of payment by the due date, the company reserves the right to cancel the reservation and apply cancellation charges.
We accept VISA or MasterCard credit cards. All payments by credit card are subject to a 2.75% fee. We reserve the right to charge to amend this fee without prior notice. No fees are charged for payments made by cheque, cash or debit cards.
Holiday Prices
We reserve the right to increase or decrease brochure prices at any time.
Price Guarantee
Once you have booked your holiday, paid your deposit and insurance premium in full and received a written confirmation from us, the price of your holiday is fully guaranteed and will not be subject to any surcharges except for increases relating to the following, which are beyond control: -
- Airport taxes and charges
- Fuel surcharges imposed by airlines
- Local tax increases imposed by Government, State or Local Authorities
- Exchange Rate Variations (we will absorb the first 2% of your holiday price)
If this means paying more than 10% of the holiday price, you will be entitled to cancel your holiday with a full refund of all money paid except for any premium paid to us for holiday insurance, amendment charges and any cancellation in respect of extras purchased.
Should you decide to cancel because of this, you must exercise your right to do so within 14 days from the issue date printed on the invoice. We reserve the right to increase prices at any time up to 56 days prior to departure subject to the above 2%-10% price guarantee. There will be no increase within 56 days, as long as the balance due has been paid in full, except in the case of bookings made within this time when all price increases may be passed on.
Documents
Travel documents will be sent to you approximately 14 days before departure, assuming full payment has been received.
Airport Taxes & Security Charge
All current charges at the time of preparation are included in our inclusive prices. Airport taxes and security charges are subject to change according to airline policy and government legislation. We reserve the right to amend our prices to adjust for these increases.
Land Only Booking Fee
A booking fee of £20 will apply for any bookings not including a transatlantic flight booked with Golf - The American Way.
Cancellations/Refunds/Changes
Notice of cancellations must be made in writing to the company or through your agent. The following cancellation charges apply: 57+days - loss of deposit; 56-48days - 30%; 47-36days - 50%; 35days of departure - 100%. Insurance premiums are non-refundable. All refunds are subject to the return of all travel documents. Once your booking has been confirmed, changes will incur the following amendment fees: outside 21 days from departure - £30 per person, per amendment; within 21 days from departure-the above plus £100 per person ticket re-issue fee.
Changes by the Company
Due to reasons beyond our control, on occasions it may be necessary to amend certain arrangements of your holiday, which we reserve the right to do at any time. We will inform you as soon as possible. Substitute hotels may be used at certain times and will be of a similar standard. A major change is one that we make to your holiday arrangement before departure that involves changing your UK departure airport, a difference of more than 12 hours in departure time from the UK, a change in your resort area or an offering of a lower classification of hotel accommodation. In these cases you have a choice of either: (a) accepting the changed arrangements as notified to you; (b) purchasing another available holiday from 'Golf -The American Way'; or (c) cancelling your holiday. If you choose (a) or (b) we will pay you compensation on the scale set out below. If you choose (c) we will also refund you all monies you have paid us.
Period before scheduled departure within which a major change is notified to you.

Once a change has been confirmed no further claims for compensation or additional expenses will be accepted. In no case will we pay compensation or accept any liability if the change is due to force majeure, risk or threat of war, industrial disputes, riot, civil strife, terrorist activity, natural/nuclear disasters, fire or adverse weather conditions, technical problems to transport, closure or congestion of airports or ports, cancellations or changes of scheduled airlines and similar events beyond our control.
If we cancel your holiday
We reserve the right in any circumstances to cancel your holiday. We will inform you as soon as possible and you will be offered an alternative holiday of comparable standard, if available, or a refund of all monies paid. Except for circumstances beyond our control, your holiday will not be cancelled less than 8 weeks before departure. Compensation as above will be payable.
Brochure Descriptions and Free Offers
Every effort has been made to ensure that accuracy of descriptions and information. However we are not always able to control all the components of the holiday arrangements and it is possible that an advertised facility may be withdrawn or changed. We are unable to accept liability for loss of an advertised facility or withdrawal of free offers.
Problems on Holiday
In the unlikely event of encountering difficulties while on holiday in the United States, it is preferable to take up the matter locally. Should any problem remain unresolved please notify our Customer Relations Department within 28 days of your return.
'Golf -The American Way' Liability
We accept responsibility in the event that services which we are contractually obliged to produce to you prove deficient or are not of the standard advertised. In respect of the services provided by air carriers, our liability in all cases shall be limited in the manner provided by International Conventions. 'Golf -The American Way' accepts no responsibility for and shall not be liable in respect of loss or damage or changes caused by force majeure.
Personal Injury
We accept responsibility for death, injury or illness caused by the negligent acts and/or omissions of our employees or agents together with our suppliers and sub-contractors whilst acting within the scope or in the course of their employment. Such responsibility shall be limited to the equivalent of such damages as you or any member of your party would be entitled to receive under English Law in an English Court. In respect of the services provided by air carriers, our liability in all cases shall be limited in the manner provided by International Conventions.
Scheduled Airlines
Air transportation will be by scheduled services of IATA airlines, or charter services operated by UK or US airlines. All details in this brochure are correct at time of printing and are liable to change by airline or by direction of any government or competent authority at any time. Whenever possible any change to schedule or flight time will be advised but it is possible that further changes can occur. We strongly recommend that the relevant airline is contacted before commencement of each flight. The right is reserved to substitute alternative aircraft and/or airlines at any time.
Flight Delays
'Golf -The American Way' will not accept liability, or pay compensation for (or the consequence of) flight delays. The airline will endeavour to assist, by allocating you seats on the next available flight and where necessary providing overnight accommodation, as in accordance with the conditions of carriage of airlines. For travel delay compensation please refer to your insurance policy.
Disabled Clients
'Golf -The American Way' is not equipped to handle the needs of the handicapped traveller and cannot be held liable for deficient services/facilities in this respect. We recommend that you contact a specialist tour operator.
Seat/Special Requests
Although we will endeavour to assist with any request, we cannot guarantee or confirm the requested service. All requests are subject to change by airlines or suppliers.
